Research Update: “Study of the Takaful Regulations in Selected Countries and Constitutional Drafts of Required Laws and Regulations in Developing Takaful System in Iran”
A research project on takaful laws and regulations has been carried out by the Islamic Studies of Insurance Department of IRC.

According to PRIAO-IRC, the research project is conducted by Dr. Fatemeh Azadbakht, Faculty Member of the Islamic Studies of Insurance Department of IRC with the collaboration of Dr. Aziz Ahmadzadeh, Vahid Nourani, and Zahra Bardal. The study is prepared in 5 sections including ‘The Generals’, ‘Concept Analysis, Theoretical Foundation, and Background of Takaful in Islamic and Contemporary History’, ‘Analysis of Takaful Documents and Operational Models of Takaful Institutions from Jurisprudent Perspective’, ‘Analysis of Operational Framework and Various Types of Takaful Funds’, and ‘Analysis of the Laws and Assessment Frameworks for Risk Assumption and Claim Payment in Takaful Institutions’.

The implementation of takaful in the country requires sufficient knowledge among its developers, preparing the jurisprudent model based on the Islamic jurisprudence and illuminating the operational and supervisory frameworks. The present study is an attempt to explicate the jurisprudent and legal foundations of takaful in selected countries and to present a view on the nature of takaful, its operations, and other relevant important issues.

Given the significance of takaful products from Shariah perspective, an elaborate jurisprudent analysis on the nature, status, and the legitimacy of various takaful models and the views of the Islamic scholars from other countries on such models are presented. These analyses can act as the basic foundation for the reviews prepared by the Jurisprudent Council of Insurance Industry. They can also help encourage takaful customers to know about its Shariah-compliant nature, and finally, they can also be used for the Shariah risks of takaful products by the risk managers of takaful operators.

The tangible outputs of the present study could be the glossary of technical and non-technical takaful terminologies, analysis of the takaful certificates and the general structure governing them, the operational models of takaful and their analysis, analysis of the takaful laws in Pakistan and Afghanistan, translation of the insurance laws in Pakistan and Afghanistan, review of the takaful in Islamic financial services and takaful law in Malaysia, and the assessment frameworks for risk assumption and claim payment in takaful.
