IRC’s Specialized Legal Desk Releases: "A Practical Guide to Claims Recovery in Insurance Companies"
The Insurance Research Center (IRC) has recently published a new report titled "A Practical Guide to Claims Recovery in Insurance Companies," prepared by its Specialized Legal Desk. The guide highlights the strategic importance of claims recovery in preserving financial resources, enhancing operational efficiency, and minimizing legal disputes within the insurance industry.
According to the IRC Public Relations Office, the publication underscores that claims recovery and the right of subrogation are two fundamental and interrelated components of the claims management process. The right of subrogation provides the legal foundation and authorization for insurance companies to engage in insurance-related litigation and recovery actions. This right is transferred to the insurer after the settlement of claims. In turn, claims recovery is the practical manifestation of this right, realized through technical investigations, negotiations, legal proceedings, and debt collection efforts. This interconnection is evident both conceptually and across all operational practices.
One of the guide’s key strengths is its structured and detailed classification of the recovery process, which is divided into four main stages:
Identification of Recoverable Claims,
Collection of Supporting Documents,
Case Segregation, and
Execution of Recovery Measures.
This systematic framework is designed to reduce duplication of effort and resource wastage while fostering greater procedural organization within insurance companies.
Additionally, the report introduces mechanisms for evaluating recovery potential, based on criteria such as:
The amount of the loss,
The insurance status of third parties,
The enforceability of court decisions, and
The financial capacity of liable parties.
These mechanisms are adaptable and applicable across all lines of insurance business.
Another significant feature of the guide is its precise delineation of decision-making authority across different organizational levels. This structure not only enhances internal control and mitigates the risk of misconduct but also accelerates decision-making processes and improves overall operational effectiveness.
